Job Summary

  • This position has a flexible work arrangement that may allow for Telework or a mixture of working in our office and Telework with occasional meetings in the office.

In the 2023 legislative session, the Governor’s Office, Minnesota legislature, and leaders for children and families worked in partnership to pass legislation establishing the Department of Children, Youth, and Families (DCYF) to create a sustainable, public face for children’s issues in state government. This new cabinet-level agency brings together programs centered on children and families, including child care and early learning, child support, child safety and permanency, economic support and food assistance, and youth opportunity. This position will begin in the Department of Human Services (DHS) Office of Inspector General (OIG) Legal Counsel’s Office, and it will move to DCYF in the summer of 2025, when other OIG functions move to DCYF.

This position exists within the Chief Legal Counsel’s Office to provide legal expertise to the Department, and in particular to the Children, Youth, and Family regulatory and enforcement divisions (CYF). The incumbent will work with the Deputy Chief Legal Counsel and will be responsible for supervising staff attorneys who focus on program-specific legal services and providing legal advice in a variety of complex and changing areas with CYF-wide implications. The incumbent will also do legal research and provide legal advice on compliance matters with overarching impact on CYF programs and assist in developing legislative initiatives.

Responsibilities include but are not limited to:

  • Advice and legal research for deputy chief legal counsel and CYF management and staff.
  • Management of CYF litigation strategies.
  • Management of legal resources.

Qualifications

Minimum Qualifications

  • JD degree from an ABA accredited law school;
  • Current license and in good standing to practice law in Minnesota;
  • At least five (5) years’ experience as a practicing attorney in an area of law related to the position with one (1) of the years working as a supervisor or in a leadership/lead role; and
  • Knowledge and experience with state and federal data privacy laws as they relate to human services programs.

Experience must demonstrate the following:

  • Strong legal research, analysis, and writing skills;
  • Building and maintaining good working relationships with internal and external stakeholders;
  • Providing legal advice to executive leadership on diverse and complex human services and data privacy matters;
  • Supervision of staff including mentoring and fostering professional development or serving in a lead/leadership role; and
  • Experience in one or more areas relevant to regulatory oversight and enforcement in human services programs such as licensing, Child Care Assistance Program (CCAP) enforcement, or other body of administrative law.

Preferred Qualifications

  • Subject matter expert in administrative law related to the work of Children, Youth and Family (CYF) including contract law and federal laws including but not limited to:
    • False Claims Act, Adam Walsh Act.
    • Child Care & Development Block Grant.
    • Human Services and Children Youth and Families Licensing Acts.
    • Limit on Receiving Public Funds.
    • Government data practices law.
  • Solve complex legal problems, giving appropriate consideration and course corrections to address non-legal factors that have potential to impact outcomes.
  • Well-developed ability to provide leadership and articulate CYF goals and objectives.
  • Develop and complete work plans consistent with the Department’s mission.
  • Analytical skills to assimilate information and apply it in strategic, decision-making processes.
  • Facilitate conflict resolution and ensure competing interests are appropriately balanced.
  • Analyze business and performance data to identify redundancies, gaps, and inefficiencies, and introduce and implement business process changes that will streamline and improve the business.
  • Communicate effectively with a large and varied constituency, including legislators and legislative staff, the Attorney General’s Office, state local and federal agencies, professional and advocacy groups, as well as the general public.
  • Maintain composure and convey competence, equanimity, and collaboration in stressful situations.
  • Variety of experiences working effectively with others from different backgrounds and cultures.
